CRITICAL EVIDENCE DISCOVERIES - Key Defence Points
Recently discovered evidence that significantly strengthens KG Project's defence against Wright Hassall's claims.
Evidence Discovery #1: The March 2021 "Notification" Myth
Wright Hassall Claim: KG Project "was notified of roof issues in March 2021" and failed to act - suggesting landlord neglect over 11 months before the 2022 repairs.
THE ACTUAL EVIDENCE (Emails 31 March - 1 April 2021):
Al's email (31 March 2021):
"My only immediate concern would be the roof - there was a leak during a heavy bout of rain back in October. It has not happened since then... Is the roof solely my responsibility or does it come under the coverage of the freehold?"
Katerina's response (1 April 2021):
"In regards of roof renovation issue I have to look into Lease Agreement and get back to you shortly."
WHY THIS DESTROYS WH's ARGUMENT:
- The leak Al mentioned was from October 2020 - 5 months before the email
- Al explicitly stated "It has not happened since then" - the leak had STOPPED
- Al was asking an informational question, not demanding urgent repairs
- Al himself said renovation works should wait until "next year" (2022)
- Katerina acknowledged and said she'd check the lease - reasonable for a non-emergency
- The March 2022 repairs were for a NEW, DIFFERENT leak - confirmed by Al's 29 Jan 2023 email: "nearly a year since the leak first occurred"
Evidence Discovery #2: The Two Different Leaks
The documentary evidence proves there were two separate leak incidents - not one ongoing problem:

Strategic Significance: Wright Hassall cannot claim Katerina ignored a roof problem for 11+ months. The October 2020 leak stopped on its own. The March 2022 emergency was a completely separate incident.
