Apologizes for delay - office closed due to COVID. Returns to London around 25th April.
No objections to Al's internal redecoration works. No renovation/construction planned this year due to tight budget.
View Original EmailAl Asks About Roof Responsibility
Al thanks Katerina. Will pay last year's Ground Rent now and this year's at end of next month.
Notes Lambeth Council has addresses listed correctly but Royal Mail and British Gas show 14-16.
Plans to change kitchen and bathroom this year. Says renovation works should wait until "next year" (2022).
STRATEGIC ANALYSIS - KEY DEFENCE EVIDENCE
This email DESTROYS Wright Hassall's narrative. WH claims (paragraph 16, 14 Nov 2025) that "your client was notified of roof issues in March 2021." This is misleading:
| WH Claim | Actual Evidence |
| Katerina was "notified" of roof issues | Al was asking an informational question - not demanding urgent repairs |
| Implies ongoing/emergency problem | Al explicitly states: "It has not happened since then" - leak had STOPPED |
| Suggests landlord neglect | The leak was from October 2020 (5 months prior) and resolved itself |
| Implies urgency ignored | Al himself said renovation works should wait until "next year" |
KEY POINT: The March 2022 repairs were for a DIFFERENT, NEW leak - not a continuation of the October 2020 incident. Al's own email of 29 January 2023 confirms: "It's been nearly a year since the leak first occurred" (referring to 2022, not 2020).
New Bank Details Notification
Katerina sends new bank details for KG Project Ltd (NatWest account).
Asks Al to save details and use for future payments.
View Original EmailAl Acknowledges Bank Details
"Thank Katerina. I will reply properly to your other note on Friday - busy with work currently. It did read well though, and I think we are aligned."
View Original EmailKaterina's Response - Reasonable Acknowledgment
Katerina thanks Al for understanding the delay with invoices.
Will try to fix the address listing issue with British Gas and Royal Mail.
STRATEGIC ANALYSIS - REASONABLE RESPONSE
Katerina's response was entirely appropriate given the circumstances:
- Al asked an informational question - Katerina said she'd check the lease
- There was NO emergency - the leak Al mentioned had already stopped
- Al wasn't demanding urgent repairs - he was asking about responsibility
- Al himself said renovation works should wait until "next year"
- This is a standard acknowledgment - not a failure to act
CRITICAL: Wright Hassall cannot claim Katerina "failed to respond" or "ignored" the issue. She acknowledged it and promised to review the lease. Given there was no emergency (the leak had stopped), this was a reasonable response to an informational query.
Receipt Request
Al requests receipt for first £250 paid yesterday.
Will pay the other £250 at end of month.
View Original EmailReceipt Sent (2019-2020)
Katerina sends receipt for Ground Rent 2019-2020.

Al asks if the roof is part of what the freehold should be maintaining and requests ground rent invoice.
View Original EmailInitial Response - Financial Constraints
Katerina acknowledges the email and states she will check the lease.
Al's Clarification on Repairs
Al clarifies he's not expecting major exterior renovation. The roof repair was essential as leaks could affect both flats (14 and 16).
Also mentions: Solutions Roofing identified brickwork issues under his windows causing condensation - willing to wait until before next winter.
Will review lease and continue paying ground rent, which he expects should be earmarked for essential maintenance.
View Original EmailLease Copy Request

View Original EmailKaterina Agrees to Provide Lease

View Original EmailAl Cites Lease - "Retained Parts"
Al obtained lease from Land Registry and makes his legal argument:
Retained Parts (page 8): "all parts of the Building other than the Property... including (a) the main structure of the Building including the roof and roof structures, the foundations, the external walls..."
Al's conclusion: The roof repair work should be funded by the freehold/landlord, not himself. Requests feedback by end of week.

View Original EmailSolicitor Engaged, Inspection Proposed

"Following on from the visit you had planned with your solicitor, do you have a further update on this please?"
"Not sure why this is taking so long to resolve. We last spoke about this at least 4-5 weeks ago."
View Original EmailKaterina Away Until January
Katerina apologizes - she is away with distance and time difference making response difficult.
"The people who are assigned to manage and resolve it will be out of the office until January."
Wishes Al good Christmas and New Year, appreciates his patience.
View Original EmailAl Issues Ultimatum
Al expresses "disappointment" that January is nearly over without resolution.
"It's been nearly a year since the leak first occurred... both my flat and also Number 16 downstairs, would have been vulnerable to leakage damage if the roof had not been promptly fixed."
Katerina Explains Solicitor Changed Firms
Katerina apologizes and explains the delay:
"I want everything to be done correctly and strictly in accordance with the terms of the lease and accounting requirements."
Spoke with him today - he assured he would be in touch with Al shortly in upcoming weeks.
View Original EmailSolicitor Questions for Al
KG Project's solicitor has questions before advising:
- Was "Solar Roofing" the only contractor with whom you got a quote? How did you choose them?
- Who is JS Whitbread?
- Why did you highlight this payment when asked for evidence that Solar had been paid?
Al's Detailed Response to Questions
Correction: It was Solution Roofing, not "Solar Roofing"
On quotes: "I do not have any documented quotes but I did some ringing around and also went on to the My Builder website... Bearing in mind the emergency nature of the leak, I did not have much time"
On director: Sole director is Matthew Dean Eastwood - "Matthew was the first name of the senior roofer on site when the roof was fixed and it was he that asked me to pay the money to 'JS Whitbread'"
View Original EmailForwarded to Solicitor
"Thank you for answering my questions. I have forwarded your reply to company's solicitor. I hope to get proper advice from them early next week."
View Original EmailAl Follows Up on Solicitor
"Given that over a week has passed away since your last note, do you have any further news from your company's solicitor please?"
View Original EmailFallen Building Pipes - Urgent
Al reports urgent building issue: drainage pipes connected to the building have fallen off the wall at the back of 14, 16 and 16A.
Pipes back onto basement flat at 62 Fentiman Road (Ms Eleanor Henson). Water dripping from open pipe which hangs from top of building.
Requests swift resolution as this is causing inconvenience. Sent from iCloud address with photos attached.
View Original EmailAl's Second Ultimatum
"Whilst you have at least addressed the situation with the fallen pipes on the back wall, once again you are ignoring my notes (and previously my phone calls) on the subject of the roof."
Stan Harris Email Confirmed
Katerina apologizes again for delays. Confirms working with Mr. Stan Harris from Salaw Solicitors.
Writing to ensure Al received the email. Prepared to engage in discussion regarding roof works and other repairs.
View Original EmailAl Acknowledges Stan Harris Letter
"To confirm that I did receive Mr Harris' email and letter. In general, there was a lot in there that I thought made good sense and understood the situation. There were however a couple of points that I took issue with and made clear in my reply back to Mr Harris."
Supports idea of independent standing person to decide disputes, as long as person is "fit and proper".
Notes concern about how freehold has been managed - issue should have been resolved a year ago.
View Original EmailSettlement Negotiations via Stan Harris

"Following the recent bad weather, including today where there has been some heavy rain in London, it would appear that the pipe or guttering is leaking onto the wall yet again."
Attaches pictures. Notes contractor warned there could be issues again. Requests return of contractors ASAP.
View Original EmailProblem Exacerbated - No Response
"I am still waiting on a response to my mail from last Saturday 19th July with regards to the leak that has sprung up along the party wall."
"We have had more bad weather this week and the problem has now exacerbated."
Requests same urgency as when Katerina assisted Eleanor Henson with pipe issue last year.
